Oakeshott Constitution Avoidance Scheme

Rob Oakeshott:

“What we have seen since the government was formed is Tony Abbott go back to his old habits of talking about conflict politics, and what we need to know is what the rules of the game are.

“Will they stick by that agreement and then we can make a decision based upon the rules of the game.”


Section 40 of the Australian Constitution Provides:


"Questions arising in the House of Representatives shall be determined by a majority of votes other than that of the Speaker. The Speaker shall not vote unless the numbers are equal, and then he shall have a casting vote."



An arrangment where a member with a different view to that of the Speaker agreeing to abstain from voting IS tantamount to the speaker casting a vote and therefore unconstitutional. 


This does not bother Rob Oakeshott  ... Sure lets just stick to an agreement with Oakeshott and just forget about  the Constitution. What about laws passed using the Oakeshott constitution avoidance scheme ? Who cares what agreements where agreed with Mr Oakeshott, they mean shit if they are unconstutional. I agree we should stick by the rules of the game, being the Constitiuon, not side arrangement between ambitious politicians.


Oakeshott went on to say that "This is not an Oakeshott ego trip". I say then what type of trip is it Mr independant MP ? The Australian parliament is not all about you.
